Collection and Use of Personal Information

Personal information is data that can be used to identify or contact a single person.

You may be asked to provide your personal information anytime you are in contact with NIMA or an NIMA affiliated company. NIMA and its affiliates may share this personal information with each other and use it consistent with this Privacy Policy. They may also combine it with other information to provide and improve our products, services, content, and advertising. You are not required to provide the personal information that we have requested, but, if you chose not to do so, in many cases we will not be able to provide you with our products or services or respond to any queries you may have.

Here are some examples of the types of personal information NIMA may collect and how we may use it:

What personal information we collect
  • When you create a NIMA account or provide your personal information, apply for commercial credit, purchase a product, download an app update, register for a giveaway, contact us or participate in an online survey, we may collect a variety of information, including your name, mailing address, phone number, email address, contact preferences, and credit card information.
  • When you share your content with family and friends using NIMA products, send gift certificates and products, or invite others to participate in NIMA services or forums, NIMA may collect the information you provide about those people such as name, mailing address, email address, and phone number. NIMA will use such information to fulfill your requests, provide the relevant product or service, or for anti-fraud purposes.
  • In certain jurisdictions, we may ask for a government issued ID in limited circumstances including when setting up the NIMA app and activating your app, for the purpose of extending commercial credit, or as required by law.
How we use your personal information
  • The personal information we collect allows us to keep you posted on NIMA's latest product announcements, app updates, and upcoming events. If you don’t want to be on our mailing list, you can opt out anytime by opting out.
  • We also use personal information to help us create, develop, operate, deliver, and improve our products, services, content and advertising, and for loss prevention and anti-fraud purposes.
  • We may use your personal information, including date of birth, to verify identity, assist with identification of users, and to determine appropriate services. For example, we may use date of birth to determine the age of NIMA fans.
  • From time to time, we may use your personal information to send important notices, such as communications about purchases and changes to our terms, conditions, and policies. Because this information is important to your interaction with NIMA, you may not opt out of receiving these communications.
  • We may also use personal information for internal purposes such as auditing, data analysis, and research to improve NIMA’s products, services, and customer communications.
  • If you enter into a sweepstake, contest, or similar promotion we may use the information you provide to administer those programs.
Collection and Use of Non-Personal Information

We also collect data in a form that does not, on its own, permit direct association with any specific individual. We may collect, use, transfer, and disclose non-personal information for any purpose. The following are some examples of non-personal information that we collect and how we may use it:

  • We may collect information such as occupation, language, zip code, area code, unique device identifier, referrer URL, location, and the time zone where a NIMA product is used so that we can better understand customer behavior and improve our products, services, and advertising.
  • We may collect information regarding customer activities on our website, product pages, our online store, contact page,  NIMA Sports App Store,  and Support Stores and from our other products and services. This information is aggregated and used to help us provide more useful information to our customers and to understand which parts of our website, products, and services are of most interest. Aggregated data is considered non‑personal information for the purposes of this Privacy Policy.
  • We may collect and store details of how you use our services, including search queries. This information may be used to improve the relevancy of results provided by our services. Except in limited instances to ensure quality of our services over the Internet, such information will not be associated with your IP address.
  • With your explicit consent, we may collect data about how you use your device and applications in order to help app developers improve their apps.

If we do combine non-personal information with personal information the combined information will be treated as personal information for as long as it remains combined.

What data we collect and how we use it

We may collect the following categories of information for the purposes explained below.

  • Advertiser website activity: This is data about your browsing activity on the Advertiser's website. For example, which pages you visited and when, and what items you placed into your online shopping cart.
  • Device and browser information: This is technical information about the device or browser you use to access the Advertiser's website. For example, your device's IP address, cookie string data and (in the case of mobile devices) your device type and mobile device's unique identifier such as the Apple IDFA or Android Advertising ID.
  • Ad data: This is data about the online ads we have served (or attempted to serve) to you. It includes things like how many times an ad has been served to you, what page the ad appeared on, and whether you clicked on or otherwise interacted with the ad.
  • Data from Advertising Partners: This is data that we receive from other digital advertising companies that we work with (“Advertising Partners”) to help us deliver ads to you and recognize you across browsers and devices. This may include pseudonymous advertiser identifiers that some Advertisers or other third party ad platforms choose to share with us, such as your "Customer ID" with an Advertiser or an identifier associated with a hashed (not readable) version of your email address. We may work with these Advertising Partners to synchronize their unique, anonymous identifiers to our own to enhance data points about a particular unique browser or device.
  • Email and Postal Addresses from Advertisers: Some Advertisers choose to share actual email addresses and postal addresses about their customers with us, so that (with the help of Advertising Partners) we can help the Advertiser serve targeted ads to customers. Also, we may assist an Advertiser with sending emails to customers (for instance, if the Advertiser is using our SendRoll service). We use the Advertiser's supplied e-mail and postal addresses for the purpose of assisting that particular Advertiser.
  • Hashed email addresses: If an Advertiser allows, we may collect hashed versions of the emails that are entered on that Advertiser’s site. These hashed emails are used as an additional identifier to help us better target ads for Advertisers, including across multiple devices or browsers.
  • We use this data to help our Advertisers identify and serve ads to you that are more relevant to you. We also use this data to operate, improve and enhance our services including enhancing the data points we or our Advertising Partners have about a particular user, browser, or device, or to target, optimize, cap, or synchronize advertising.
Cookies and Other Technologies

NIMA's websites, online services, interactive applications, email messages, and advertisements may use "cookies" and other technologies such as pixel tags and web beacons. These technologies help us better understand user behavior, tell us which parts of our websites people have visited, and facilitate and measure the effectiveness of advertisements and web searches. We treat information collected by cookies and other technologies as non‑personal information. However, to the extent that Internet Protocol (IP) addresses or similar identifiers are considered personal information by local law, we also treat these identifiers as personal information. Similarly, to the extent that non-personal information is combined with personal information, we treat the combined information as personal information for the purposes of this Privacy Policy.

Ads that are delivered by NIMA’s advertising platform may appear in NIMA News and in the NIMA Store. If you do not wish to receive ads targeted to your interests from NIMA’s advertising platform, you can choose to opt out of NIMA and receiving such ads regardless of what device you are using. 

NIMA and our partners also use cookies and other technologies to remember personal information when you use our website, online services, and applications. Our goal in these cases is to make your experience with NIMA more convenient and personal. 

As is true of most internet services, we gather some information automatically and store it in log files. This information includes Internet Protocol (IP) addresses, browser type and language, Internet service provider (ISP), referring and exit websites and applications, operating system, date/time stamp, and clickstream data.

We use this information to understand and analyze trends, to administer the site, to learn about user behavior on the site, to improve our product and services, and to gather demographic information about our user base as a whole. NIMA may use this information in our marketing and advertising services.

In some of our email messages, we use a “click-through URL” linked to content on the NIMA website. When customers click one of these URLs, they pass through a separate web server before arriving at the destination page on our website. We track this click-through data to help us determine interest in particular topics and measure the effectiveness of our customer communications. If you prefer not to be tracked in this way, you should not click text or graphic links in the email messages.

Pixel tags enable us to send email messages in a format customers can read, and they tell us whether mail has been opened. We may use this information to reduce or eliminate messages sent to customers.

The AdRoll platform uses cookies, tracking pixels and related technologies to provide our services for Advertisers. Cookies are small data files that are served by our platform and stored on your device. They enable us to identify your device when you move between different websites and applications, so that we can serve targeted advertising to you.

Specifically, the AdRoll cookie we serve through the AdRoll platform for this purpose is named “__adroll”. We may also drop an additional AdRoll opt-out cookie if you opt-out as described below. We may also drop cookies from our Advertising Partners for the purposes described above. The Advertising Partner cookies dropped vary by Advertiser implementation.

Your choices and opting-out

We recognize how important your online privacy is to you, so we offer the following options for controlling the targeted ads you receive and how we use your data:

  • You can opt out of receiving targeted ads served by us or on our behalf by clicking on the blue icon that typically appears in the corner of the ads we serve or by clicking here. Please note that, if you delete your cookies or upgrade your browser after having opted out, you will need to opt out again. Further, if you use multiple browsers or devices you will need to execute this opt out on each browser or device. If you opt-out we may collect some data about your online activity for operational purposes (such as fraud prevention) but it won't be used by us for the purpose of targeting ads to you.
  • AdRoll is also a member of the Network Advertising Initiative (NAI) and adheres to the NAI Codes of Conduct. You may use the NAI opt out tool here, which will allow you to opt out of seeing targeted ads from us and from other NAI approved member companies.

  • We also comply with the Self-Regulatory Principles for Online Behavioral Advertising as managed by the Digital Advertising Alliance (DAA). You may opt out of receiving targeted ads from other companies that perform ad targeting services, including some that we may work with as Advertising Partners via the DAA website here.

  • We also comply with the Canadian Self-regulatory Principles for Online Behavioral Advertising as managed by the Digital Advertising Alliance of Canada (DAAC). You may opt out of receiving targeted ads from other companies that perform ad targeting services, including some that we may work with as Advertising Partners via the DAAC website here.

  • We also adhere to the European Interactive Advertising Digital Alliance (EDAA) guidelines for online advertising and you may opt out via their Your Online Choiceswebsite.

  • Please note that when using the ad industry opt-out tools described above:

    • If you opt-out we may still collect some data about your online activity for operational purposes (such as fraud prevention) but it won't be used by us for the purpose of targeting ads to you.
    • If you use multiple browsers or devices you may need to execute this opt out on each browser or device.
    • Other ad companies’ opt-outs may function differently than our opt-out.
  • To opt out of receiving targeted ads that are based on your behavior across different mobile applications follow the below instructions, for iOS and Android devices:
    • iOS 7 or Higher: Go to your Settings > Select Privacy > Select Advertising > Enable the “Limit Ad Tracking” setting
    • For Android devices with OS 2.2 or higher and Google Play Services version 4.0 or higher: Open your Google Settings app > Ads > Enable “Opt out of interest-based advertising”

Opting out will not prevent you from seeing ads, but those ads will likely be less relevant because they won’t be tailored to your interests. The ads might, for instance, be randomly generated or based on the web page you are visiting.

Some internet browsers allow users to send a "Do Not Track" signal to websites they visit. We do not respond to this signal.

In addition, if you are located in the European Economic Area you may also have the right to access, correct or update some of the information we hold about you. You can also request that we delete your information. If you wish to exercise any of these rights, please contact us at delight@adroll.com. Please note that in many cases, we hold identifiable information only on behalf of our Advertiser clients, and we may instead direct you to contact them.

Disclosure to Third Parties

At times NIMA may make certain personal information available to strategic partners that work with NIMA to provide products and services, or that help NIMA market to customers. 

Service Providers

NIMA shares personal information with companies who provide services such as information processing, extending credit, fulfilling customer orders, delivering products to you, managing and enhancing customer data, providing customer service, assessing your interest in our products and services, and conducting customer research or satisfaction surveys. These companies are obligated to protect your information and may be located wherever NIMA operates.

Others

It may be necessary − by law, legal process, litigation, and/or requests from public and governmental authorities within or outside your country of residence − for NIMA to disclose your personal information. We may also disclose information about you if we determine that for purposes of national security, law enforcement, or other issues of public importance, disclosure is necessary or appropriate.

We may also disclose information about you if we determine that disclosure is reasonably necessary to enforce our terms and conditions or protect our operations or users. Additionally, in the event of a reorganization, merger, or sale we may transfer any and all personal information we collect to the relevant third party.

Protection of Personal Information

NIMA takes the security of your personal information very seriously. 

When you use some NIMA products, services, or applications or post about NIMA, chat room, or social networking service, the personal information and content you share is visible to other users and can be read, collected, or used by them. You are responsible for the personal information you choose to share or submit in these instances. 

Integrity and Retention of Personal Information

NIMA makes it easy for you to keep your personal information accurate, complete, and up to date. We will retain your personal information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law.

Access to Personal Information

For other personal information we hold, we will provide you with access for any purpose including to request that we correct the data if it is inaccurate or delete the data if NIMA is not required to retain it by law or for legitimate business purposes. We may decline to process requests that are frivolous/vexatious, jeopardize the privacy of others, are extremely impractical, or for which access is not otherwise required by local law. Children & Education

We understand the importance of taking extra precautions to protect the privacy and safety of children using NIMA products and services. 

If we learn that we have collected the personal information of a child under 13, or equivalent minimum age depending on jurisdiction, outside the above circumstances we will take steps to delete the information as soon as possible.

International Users

All the information you provide may be transferred or accessed by entities around the world as described in this Privacy Policy.

All such communications are examined and replies issued where appropriate as soon as possible. If you are unsatisfied with the reply received, you may refer your complaint to the relevant regulator in your jurisdiction. NIMA cares about your privacy. This privacy policy tells you what information we collect at our websites and how we use it. If you choose to visit any of the NIMA websites, your visit is subject to this privacy policy, and you agree to the terms of it.

WHAT INFORMATION WE COLLECT

There are many places at our sites where you can share your personal information with us, and where you can communicate with others.

Registration. Some of our sites give you the opportunity to register with us, and sometimes registration is required before certain site features can be used. Newsletters and Other Communications from Us. Our registered users and customers may receive newsletters, email communications, or communications through other channels for, among other purposes, the promotion and marketing of a product or service from our family of sites and business properties, and business partners, and we may also offer other visitors to our sites the opportunity to sign up to receive such information. When there is a separate sign-up for newsletters, we ask for contact information such as name and email address, and, sometimes, demographic and profile information. By visiting our sites, you affirmatively consent to our collection and use of your data. We use this information in the same manner as we use the contact information in the Registration process described above. We may offer our users the choice whether to receive mailings from others that we think will be of interest. Communications with Others. We may offer features where you can send information to others. We will use the contact information you enter to send the information requested.

Interactive and Community Features. Our sites may offer interactive and community features, such as message boards, chat, email accounts, short message service (SMS), instant messaging, profiles, personal homepages, etc. All information posted or sent through these features may be publicly available, and you should be aware that when you voluntarily disclose personal information (e.g., user name, email address, phone number) through these features, that information can be collected and used by others and may result in unsolicited communications from other people. Contests, Sweepstakes and Surveys. We may also have contests, sweepstakes and surveys at our sites. When you enter or participate in them, we request contact information from you (such as your full name, email address, mailing address, and telephone number) and may also request demographic or profile information. We will use the information you provide for the purpose of conducting the promotion (for example, to contact you if you have won). We may also use the information to send you newsletters and other information we think may be of interest. AUTOMATIC DATA COLLECTION

Our web sites may have features that automatically collect information from users to assist us in creating sites that honor our users' preferences and serve their interests and needs.

Some of our sites use cookies, which are small data files containing information about the user that are stored on the user's hard drive. Some cookies are used to make login to our sites easier (such as by remembering usernames and passwords). Cookies can also enable us to track users' movements and target their interests to enhance their experience at our sites. Most common web browsers today, such as Chrome, Firefox and Internet Explorer, allow you to modify your settings to block cookies entirely, alert you every time they are being sent, or allow their use by only those web sites you choose.  You can also delete cookies that are currently stored on your computer’s hard drive.  Please note that if you disable/delete all cookies stored on your computer, you will have also disabled the cookies that are used by NAI to help prevent you from receiving unwanted advertising from third party ad networks.  Through the use of web logs or log files, we may also gather information such as the date, time, browser type, navigation history, and IP address of all visitors to our site(s). We use this information for our internal security audit log, trend analysis, and system administration, and to gather broad demographic information about our user base. We may associate this information with your personal information. By visiting our sites, you affirmatively consent to our collection, use, and distribution of your data.

WITH WHOM YOUR INFORMATION IS SHARED

Information provided at any sites that we host or manage may be shared with the owner(s) of such site(s). As with other third parties, we are not responsible for how the owner(s) handle the data once they receive it. When we have co-branded or sponsored services, when we host a site, or when we join with other parties to provide specific services, we may share (provide and receive) your personal information with them. By visiting these sites, you affirmatively consent to our collection, use and distribution of your data.

We may share your information with other third parties with whom we have business relationships and, in some cases, we cannot control or know their privacy practices. By visiting our sites, you affirmatively consent to our collection, use, and distribution of your data.

Other than as set forth in this policy, we do not share your personally identifiable information with other companies, apart from those acting as our agents in providing our service to you, and which agree to use it only for that purpose and to keep the information secure and confidential. Also, please be aware that our business units, subsidiaries, affiliates and sites, and entities into which our companies may be merged, or entities to which any of our assets, products, sites or operations may be transferred, may obtain from us and be able to use your personal information. We may share (provide and receive) aggregate information, which is not personally identifiable, with others. This information may include demographic data such as the gender and/or geographic location of groups of users, but it will not include personal information (such as your name or email address). We use aggregate demographic information about our audience in order to improve our service, for research purposes, marketing/promotional purposes and/or for industry reporting purposes, among others.

CHOICE

By accepting this privacy policy, you expressly choose to receive certain communications from us and third parties, and you expressly agree to the privacy practices described herein. Our sites may also provide you with additional specific opportunities to select communications you wish to receive. You may change your privacy preferences, e.g. choose to cease receiving certain communications, by informing us of your new preferences. We will be able to honor your new preferences most quickly if you inform us of them by following the appropriate instructions in any communication you receive from us. ACCESS 

If a user's personally identifiable information changes (such as zip code), we endeavor to provide a way to correct or update that user's personal data. Please feel free to contact us if you have any questions regarding making changes to your data.

DATA COLLECTION FROM CHILDREN

We strive to comply with the Children's Online Privacy Protection Act (COPPA). We do not knowingly collect personal information from U.S. children under 13 without appropriate parental notice and consent. We are committed to protecting children's privacy.

Security for all personally identifiable information is extremely important to us. We store your personal information securely, and use special procedures designed to protect the information we collect from loss, misuse, unauthorized access or disclosure, alteration or destruction.

MERCHANT/E-COMMERCE AREAS

Some of our sites have merchant/e-commerce areas, where users can purchase goods and services.  Those areas are powered by a third-party e-commerce vendor that we have engaged.  Personal information (excluding credit card or other financial information) collected by the vendor is shared with NIMA and is subject to this Privacy Policy.

We are not responsible for those other sites, their privacy policies or how they treat information about their users, and we advise you to check their privacy policies.

PRIVACY POLICY CHANGES

We reserve the right to modify, alter or otherwise update this Privacy Policy at any time, so we encourage you to review this policy from time to time. Changes to this privacy policy are effective at the time they are posted and your continued use of our sites after posting will constitute acceptance of, and agreement to be bound by, those changes.
